Pour le Conseil d'Etat, une erreur matrielle d'enveloppe ne justifie pas l'limination de l'offre
Le Conseil d'Etat, par un arrêt du 7 novembre 2008, a considéré que le fait qu'un document, qui aurait dû être présenté dans l'enveloppe contenant l'offre du candidat, ait été inclus par erreur dans l'enveloppe des candidatures ne permettait pas d'éliminer cette offre si l'égalité entre les entreprises candidates n'était pas affectée par une telle erreur.
Dans cette affaire, l'offre de la société Hexagone 2000, présentée dans le cadre d'un marché de fournitures de bennes destinées aux déchetteries de la région de Saint-Lô, avait été rejetée par la commission d'appel d'offre du syndicat mixte du Point Fort au motif que l'enveloppe contenant l'offre de la société ne comportait pas l'un des document exigé par le règlement de consultation et le cahier des clauses techniques particulières du marché.
